Obi, who disclosed this during the resumed proceedings of his petition challenging the victory of the All Progressives Congress (APC) candidate, Asiwaju Bola Tinubu, stated that he would require seven weeks to present his case before the court.

Addressing the court through his legal team led by Prof. Awa Kalu, SAN, Obi expressed the need for the extended timeframe due to a few challenges encountered at the Independent National Electoral Commission (INEC).Continue Reading>>>>

He explained, “My lords, we still face a few hiccups at INEC regarding the court’s order on March 8, which directed them to allow us to conduct a forensic examination of the BVAS. They have not complied with this order. We are also awaiting some documents we have requested from them.”

Prof. Kalu informed the court that the parties involved agreed to allocate 30 minutes for each star witness to present their evidence-in-chief, excluding any time needed for potential demonstrations of electronic evidence. However, INEC, represented by Mr. Abubakar Mahmood, SAN, stated that they had no prior agreement with Obi or the Labour Party regarding the time allocated to the witnesses. The electoral body also denied knowledge of any challenges faced by the petitioners.

The petitioners argue that INEC, during the presidential election, was obligated to implement and utilize technological devices for voter accreditation, verification, continuation, and authentication, as outlined in its regulations.

They seek the court’s declaration that Tinubu was not qualified to contest the election and that all votes cast in his favor were considered wasted due to his alleged disqualification.

As the legal proceedings unfold, the court will carefully consider the evidence presented by both parties, ultimately determining the validity of the claims made by Mr. Peter Obi and the Labour Party regarding the alleged rigging in the 2023 presidential election.
